Who Can Enter
1. To be eligible to participate in this contest, entrants must be Mid-Michigan residents who are 18 years of age or older, reside in the WSMH viewing area, and if entering by Facebook, are an existing user of Facebook.
2. Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., WSMH, Inc., and any other company which owns, programs or provides other services to television broadcast station WSMH (the “Station”), Fenton Footcare, Jenny B’s Garden Party, Whigville Market, Facebook, Inc., Facebook.com, The Douglas Group, Inc. dba UPICKEM, their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren. Only one winner per household.
How to Enter
(a) No purchase is necessary to enter. Only one entry per registered user per week.
(b) To enter, log on to www.wsmh.com, complete the Upickem online entry form with name, address, age, phone number, and upload a summer fun photo of yourself to the website Alternatively, log onto the WSMH FOX66 Facebook page at www.facebook.com/wsmhfox66, Fenton Foot Care’s Facebook page at http://www.facebook.com/fentonfootcare, or Whigville Market’s Facebook page at www.facebook.com/WhigvilleMarket and click “Like” to access the Summer Fun Photo Contest online contest entry page and UPICKEM online entry form. Complete the online entry form with your name, address, phone number, and birth date in the provided area, upload your summer fun picture of yourself, and click submit. No mechanically reproduced or completed entries will be accepted.
(c) By entering, entrants represent and warrant (i) that they own the photograph submitted, (ii) it does not violate the rights of any third parties, (iii) the picture has not been altered or enhanced with any software (excluding redeye), and (iv) that they agree to the terms and conditions located at http://www.wsmh.com/sections/station/legal/terms.shtml. No lewd, nude, or offensive photographs (as determined by the Station in its sole and absolute discretion) will be accepted. The Station reserves the right in its sole and absolute discretion to disqualify any entry.
(d) The contest starts on Friday, July 6, 2012 and ends at 11:59 p.m. CDT on Thursday, August 30, 2012. (the “Contest Period”). Entries must be received by 11:59pm CDT on each Thursday during the Contest Period to qualify for the weekly qualifying prize. Station is not responsible for lost, late, or misdirected entries, or for printing errors, server unavailability, computer or any other electronic malfunction.
(e) Each entry will be judged and scored by a panel of 4 judges comprised of Station personnel based on the following criterion: 25% content, 50% appearance, and 25% creativity. Each Friday during the Contest Period, one (1) qualifier will be selected based on the score for the criterion set forth above, for a total of eight (8) qualifiers. The photo with the second & third highest score will carry over to the next weekly judging. Other remaining valid entries will not carry over to the next weekly judging.
(f) Between Saturday, September 1, 2012 at 12:01am and Sunday, September 30, 2012 at 11:59pm CDT, viewers will be asked to vote online at www.wsmh.com or www.facebook.com/wsmhfox66 for his/her favorite qualifying picture. Voting is limited to one vote per registered user per day. Duplicate votes will be disqualified. On Monday, October 1st, the Station will determine the grand prize winner based on the picture entry with the most valid votes. The Station reserves the right to determine in its sole and absolute discretion whether the online votes are valid, and may disqualify any duplicate votes. Multiple and/or irregular votes or multiple votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source will be considered invalid. In the event of a tie, (1) winner will be randomly selected from among the tied qualifiers.
(g) To be eligible to vote in this contest, voters must be Mid-Michigan residents who are 18 years of age or older, reside in the WSMH viewing area, and a registered user of Upickem. Photo qualifiers can vote for themselves, but are not eligible to win the voter prize. By voting, each registered Upickem user who submits a vote for this contest will be entered to win a prize. On October 1, 2012, one (1) voter winner will be randomly selected from among valid Upickem users who voted in the Summer Fun Photo Contest.
(h) All entries received that are mutilated, tampered with, incorrect, illegible, or from ineligible entrants will be void. All entries become the property of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc. and the Station and will not be acknowledged or returned.
The Prize(s)
1. Each of the eight (8) qualifiers will receive one of the following prizes (as posted in advance on the Station’s website each week): $25 Whigville Market gift card, Large Flower Basket from Jenny B’s Garden Party valued at $30, OR one pair of Spenco Orthotic Sandles from Fenton Footcare valued at $50. One (1) voter winner will receive a prize pack which includes a $25 Whigville Market gift card, Large Flower Basket from Jenny B’s Garden Party valued at $30, and one pair of Spenco Orthotic Sandles from Fenton Footcare valued at $50. One (1) grand prize winner will receive a Fujifilm FinePix Real 3D W3 Digital Camera along with a prize pack which includes a $50 Whigville Market gift card and Large Flower Basket from Jenny B’s Garden Party valued at $30. Each qualifier prize is valued between $25-$50. The voter winner prize is valued at $105. The grand prize value is $291.94. Winners will be notified of exact prize values.
2. Qualifiers and winner(s) will be notified by phone. Before claiming prizes, qualifiers and winners must provide their correct name, address and telephone number to Station at the time of notification. Qualifiers and winner(s) must sign and return a release and affidavit of eligibility, which must be received within 7 days of notification at the time qualifiers and winner(s) claim his/her prize in person at the Station. Qualifiers and winner(s) must show picture identification to claim prizes. Station reserves the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.
3. If a qualifier cannot be notified within 3 days, or does not timely sign and return the release and affidavit of eligibility, then the prize will be forfeited, and another qualifier will not be selected. If the grand prize winner cannot be notified within 3 days, or does not timely sign and return the release and affidavit of eligibility, then the prize will be forfeited, and the prize will be awarded to an alternate winner with the next highest number of votes, as determined by the Station in its sole and absolute discretion. If the voter winner cannot be notified within 3 days, or does not timely sign and return the release and affidavit of eligibility, then the prize will be forfeited, and another voter winner will be randomly selected from among remaining valid voters.
4. There will be no substitutions or cash alternatives for prizes except at the sole discretion of Station. The Station has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
5. Each qualifier and winner is responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules. Winner must sign a W-9 form.
6. Only one prize will be awarded per household.
7. WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize.
8. WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not responsible for any liabilities arising directly or indirectly from the award or use of the prize.
9. In claiming your prize, you acknowledge that WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. have the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner for promotional purposes without financial remuneration.
Odds of Winning/Miscellaneous
1. Odds of winning depend on the number of entries and votes received.
2. Complete contest rules are available Monday through Friday during normal business hours at G-3463 W. Pierson Rd. Flint, MI 48504 or at www.wsmh.com.
3. For a list of prize winners, send a separate, self-addressed, stamped envelope to SUMMER FUN PHOTO CONTEST at 3463 W. Pierson Rd. Flint, MI 48504 no later than October 15, 2012.
4. This contest is subject to all applicable laws and regulations and is void where prohibited. Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., WSMH, Inc., Fenton Footcare, Jenny B’s Garden Party, Whigville Market, Facebook, Inc., Facebook.com, and The Douglas Group, Inc. dba UPICKEM accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
5. Station cannot be held liable for any lost or stolen entries, prizes or contest information.
6. Station reserves the right to make rules and contest changes and change the aforementioned contest dates.
7. By entering this contest, each entrant waives any and all claims of liability against the Station, any sponsors, Facebook.com, and their respective parent, affiliates, officers, directors, employees and agents, for any and all claims, loss, damage or injury which may occur as a result of entrant’s participation in this contest.
