Who Can Enter
1. To be eligible to participate in this contest, entrants must be Mid-Michigan residents who are 21 years of age or older, reside in the WSMH viewing area, and if entering by Facebook, are an existing user of Facebook.
2. Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., WSMH, Inc., and any other company which owns, programs or provides other services to television broadcast station WSMH (the “Station”), Dr. Tom Bossi, Dr. Saqib Ahmad, Dr. Danish, Dr. Saha, Dr. Abd Alghanem, Facebook, Inc., Facebook.com, The Douglas Group, Inc. dba UPICKEM, their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren. Only one winner per household.
How to Enter
(a) No purchase is necessary to enter. Only one entry per registered user.
(b) To enter, log on to www.wsmh.com, complete the Upickem online entry form with name, address, age, phone number, write a short essay (not to exceed 250 words) describing “how breast cancer has affected your life”, and upload a photo of yourself to the website. Alternatively, log onto the WSMH FOX66 Facebook page at www.facebook.com/wsmhfox66 and click “Like” to access the Cruise for Breast Cancer Awareness online contest entry page and UPICKEM online entry form. Complete the online entry form with name, address, age, phone number, write a short essay describing “how breast cancer has affected your life”, upload a photo of yourself, and click submit. No mechanically reproduced or completed entries will be accepted.
(c) The essay topic “How breast cancer had affected your life” must be based on your own personal experience with breast cancer as a patient, survivor, family member, friend, health care provider, or advocate.
(d) By entering, entrants represent and warrant (i) that they own the photograph submitted, (ii) the essay submitted it his/her own work; (iii) the photograph and essay do not violate the rights of any third parties, (iv) the photograph has not been altered or enhanced with any software (excluding redeye), and (v) that they agree to the terms and conditions located at http://www.wsmh.com/sections/station/legal/terms.shtml. No lewd, nude, or offensive photographs (as determined by the Station in its sole and absolute discretion) will be accepted. The Station reserves the right in its sole and absolute discretion to disqualify any entry.
(e) The contest starts on Thursday, September 13, 2012 and all entries must be received by Station by 11:59 p.m. CDT on Sunday, October 14, 2012 to qualify for the Voting Period, as further described below. Station is not responsible for lost, late, or misdirected entries, or for printing errors, server unavailability, computer or any other electronic malfunction.
(f) Between Monday, October 15, 2012 at 9:00am and Wednesday, October 31, 2012 (the “Voting Period”) at 11:59pm CDT, viewers will be asked to vote online at www.wsmh.com or www.facebook.com/wsmhfox66 for the essay entrant most deserving to win a cruise. Voting is limited to one vote per registered user per day. Duplicate votes will be disqualified. On Thursday, November 1, 2012, the Station will determine one (1) grand prize winner based on the essay entry with the most valid votes. The Station reserves the right to determine in its sole and absolute discretion whether the online votes are valid, and may disqualify any duplicate votes. Multiple and/or irregular votes or multiple votes from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means or other source will be considered invalid. In the event of a tie, (1) winner will be randomly selected from among the tied entrants.
(g) To be eligible to vote in this contest, voters a registered user of Upickem.
(h) As a condition of winning, winner must be able to provide sufficient documentation, as determined by the Station in its sole and absolute discretion, to support the content of his/her essay submitted. The Station may disqualify such winner based on the lack of such documentation or lack of personal experience with breast cancer.
(i) All entries (including essays and photographs) received that are duplicate, mutilated, tampered with, incorrect, illegible, or from ineligible entrants will be void. All entries (including essays and photographs) become the property of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc. and the Station and will not be acknowledged or returned.
The Prize(s)
1. One Grand Prize Winner will receive a $250 VISA gift card, $50 Navistarz Bar and Grill gift card, Cyrill Salon and Spa $200 package consisting of a manicure, pedicure, facial and hair cut and color, and a tropical cruise for two (2). Destination will depend on when travel occurs. The winner will be advised of the actual prize value. The grand prize includes round trip airfare for two (2) from a Mid-Michigan airport to an airport closest to the cruise departure city (economy class), one (1) inside cabin (double occupancy) for 2 nights, 3 days, meals, selected non-alcoholic beverages, and entertainment. The winner is responsible for any and all travel-related expenses not expressly stated in the prize description, including, without limitation, airport transfers, baggage fees, miscellaneous airline fees, beverages, gratuities, trip insurance, shore excursions, other transportation, fuel surcharges, other meals, port charges, taxes and surcharges, or any other incidental expenses. The prize must be used by April 1, 2013, is subject to availability, reservation, and blackout dates may apply. Winner may upgrade cabin selection at their own additional expense and subject to availability. Winner agrees that the cruise is subject to the terms and conditions of the selected cruise line and will be required to sign additional documents. Winner and travel companion will need a passport to travel.
2. Winner will be notified by phone. Before claiming prizes, winner must provide their correct name, address and telephone number to Station at the time of notification. Winner must sign and return a release and affidavit of eligibility, which must be received within 7 days of notification. All persons traveling on the trip must be 21 years of age or over, unless travelers under 21 are accompanied by at least one adult who is the parent or legal guardian of all of the minors. All persons traveling on the trip must also sign and return a release which must be returned with the winner’s release and affidavit of eligibility within the time frame specified above. Qualifiers and winner(s) must show picture identification to claim prizes. Station reserves the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.
3. If the grand prize winner cannot be notified within 3 days, or does not timely sign and return the release and affidavit of eligibility, then the prize will be forfeited, and the prize will be awarded to an alternate winner with the next highest number of votes, as determined by the Station in its sole and absolute discretion.
4. There will be no substitutions or cash alternatives for prizes except at the sole discretion of Station. The Station has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
5. The winner is responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules. Winner must sign a W-9 form.
6. Only one prize will be awarded per household.
7. WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize.
8. WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not responsible for any liabilities arising directly or indirectly from the award or use of the prize.
9. In claiming your prize, you acknowledge that WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. have the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner for promotional purposes without financial remuneration.
Odds of Winning/Miscellaneous
1. Odds of winning depend on the number of entries and votes received.
2. Complete contest rules are available Monday through Friday during normal business hours at G-3463 W. Pierson Rd. Flint, MI 48504 or at www.wsmh.com.
3. For a list of prize winners, send a separate, self-addressed, stamped envelope to Cruise for Breast Cancer Awareness at 3463 W. Pierson Rd. Flint, MI 48504 no later than December 15, 2012.
4. This contest is subject to all applicable laws and regulations and is void where prohibited. Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., WSMH, Inc., Dr. Tom Bossi, Dr. Saqib Ahmad, Dr. Danish, Dr. Saha, Dr. Abd Alghanem, Facebook, Inc., Facebook.com, and The Douglas Group, Inc. dba UPICKEM accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
5. Station cannot be held liable for any lost or stolen entries, prizes or contest information.
6. Station reserves the right to make rules and contest changes and change the aforementioned contest dates.
7. By entering this contest, each entrant waives any and all claims of liability against the Station, any sponsors, Facebook.com, and their respective parent, affiliates, officers, directors, employees and agents, for any and all claims, loss, damage or injury which may occur as a result of entrant’s participation in this contest.
